2. What Personal Data We Collect
Candidates: full name, address, contact details, CV and employment history, qualifications, right to work documentation, references and referee details, DBS check information (where required for Early Years placements), availability and job preferences, notes from telephone conversations and interviews, bank details (where required for payroll).
Clients: company name, address and contact details, names and contact details of individual contacts, vacancy details and job descriptions, notes from telephone conversations and meetings.
3. How We Use Your Personal Data
Candidates: to assess suitability for job opportunities, to introduce you to prospective employers, to manage the recruitment process, to carry out right to work checks, to process payroll or facilitate umbrella arrangements, to maintain our candidate database, to contact you about relevant opportunities, and to comply with legal obligations.
Clients: to provide recruitment services, to manage our business relationship, to process invoices, and to comply with legal obligations.
4. Our Lawful Basis for Processing
We rely on legitimate interests, contract, legal obligation, and consent as our lawful bases under UK GDPR.
5. Self-Employed Consultants
ABC Staffing Group Limited is the sole data controller for all personal data processed in connection with our recruitment services. From time to time, we engage self-employed recruitment consultants to provide services to us. These consultants may collect personal data on our behalf (for example, by sourcing candidates or developing client relationships), upload personal data into our systems, and access personal data already held on our systems in order to deliver our services.
When self-employed consultants handle your personal data they do so strictly on our behalf, under the terms of a written agreement with us. They are bound by confidentiality and data-protection obligations equivalent to those that apply to our own staff, including obligations relating to security, lawful processing, breach reporting, and the proper handling of subject rights requests.
All personal data held on our systems is the property of ABC Staffing Group Limited. Self-employed consultants have no right to retain, copy, transfer or further use any personal data after their engagement with us ends.
To enable us to provide a continuous and high-quality service, personal data on our customer relationship management system may be accessible to more than one consultant or member of staff engaged by us. Access is controlled and restricted to those who need it for legitimate business purposes connected with our services.
If you wish to exercise any of your data protection rights, please contact us directly using the contact details in this policy. All such requests are handled by ABC Staffing Group Limited, not by individual consultants.
6. Who We Share Your Personal Data With
- Client organisations: where we believe you are a suitable candidate for a role
- Self-employed consultants engaged by us: to provide recruitment services, who access personal data strictly on our behalf and on the terms set out in Section 5
- Quba Solutions: our CRM platform, acting as a data processor on our behalf
- Clipper Contracting: our umbrella payroll provider, for temporary placement payroll
- Regulatory and legal authorities: where required by law
We do not sell, rent, or share your personal data with any third party for marketing purposes.
7. Call Recording
Telephone calls may be recorded for quality assurance, training, and compliance purposes. Recordings are stored securely. If you do not wish for your call to be recorded, please inform us at the beginning of the call.
8. How Long We Keep Your Personal Data
- Active candidate records: up to 2 years following last interaction
- Placed candidate records: up to 6 years following end of engagement
- Client records: up to 6 years following end of business relationship
- Call recordings: up to 12 months
- DBS and right to work documentation: in line with regulatory guidance
9. Your Rights
Under UK GDPR you have the right to access, rectify, erase, restrict processing, data portability, object to processing, and withdraw consent. To exercise any right contact us at info@abcstaffing.co.uk. We will respond within one calendar month.
10. Data Security
We have implemented appropriate technical and organisational measures to protect your data. We control access to our systems on a need-to-know basis. All persons accessing personal data through our systems, including self-employed consultants, are subject to written confidentiality and data-protection obligations. In the event of a data breach we will notify the ICO within 72 hours.
